This End User License Agreement ("Agreement") is between you ("User") and Capped Bermuda LLC, d/b/a Thought Download ("we," "us," "our"). By downloading, installing, or using the Thought Download app, you agree to be bound by this Agreement. If you do not agree, do not download or use the app.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Thought Download app on a mobile device that you own or control, for your personal, non-commercial use only.
You may not:
Your journal entries and CTFAR entries are stored locally on your device. We do not access, collect, or store your personal journal content. See our Privacy Policy for full details.
We may release updates to the app from time to time. Updates may add, modify, or remove features. Continued use of the app after an update constitutes acceptance of any changes to this Agreement.
This Agreement begins when you download the app and continues until terminated. You may terminate it at any time by deleting the app from your device. We may terminate this Agreement immediately if you violate any of its terms. Upon termination, your license to use the app ends.
If you downloaded the app from Apple's App Store, Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple has the right to enforce this Agreement against you. This Agreement is between you and us — not between you and Apple. Apple has no obligation to provide maintenance or support for the app.
The same applies to Google if you downloaded via Google Play.
You represent that you are not located in a country subject to a U.S. government embargo or on a U.S. government prohibited parties list.
The app is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or free of harmful components. Thought Download is a journaling tool, not a substitute for professional mental health care.
To the fullest extent permitted by applicable law, Capped Bermuda LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the app. Our total liability shall not exceed fifty dollars ($50.00).
You agree to indemnify and hold harmless Capped Bermuda LLC from any claims, damages, or expenses arising from your use or misuse of the app, or your breach of this Agreement.
This Agreement is governed by the laws of the State of Utah, United States. If you are a citizen of a European Union country, the governing law and forum shall be the laws and courts of your usual place of residence.
